Affiliation : General Terms

Between: Tangerine Retreat , hereafter referred to as “the Company,” and “the Affiliate.”
Preamble
The Company operates an online booking site specialized in wellness retreats, tangerineretreat.com. The Affiliate wishes to promote the Company’s services in exchange for a commission on sales made through their promotional efforts.
Article 1: Purpose of the Contract
The purpose of this contract is to define the terms and conditions under which the Affiliate will promote the Company’s services in exchange for compensation.
Article 2: Registration and Validity of the General Terms of Affiliation
The application for registration to the affiliate program is made solely on the Company’s website at the page https://tangerineretreat.com/affiliate-registration/.
Submitting the registration form on the aforementioned page implies unreserved adherence to these General Terms of Affiliation, which come into effect once the Company accepts the Affiliate’s application.
Article 3: Personal Space
The Affiliate can track their conversions via an affiliate area accessible using information provided during registration. This area, accessible at https://tangerineretreat.com/affiliate-account/, is strictly confidential. The Affiliate may be held responsible for any damage caused by a third party to whom they have disclosed their login details.
Article 4: Affiliate Compensation
The Company’s website offers a free pre-reservation before reviewing the prospect’s file. At this stage, the prospect is not committed and is not considered a client, which does not result in the payment of a commission. Commissions are calculated when prospects are converted into clients, meaning they have paid the full amount for the chosen service. The Affiliate receives a commission of €100 (excluding VAT) on all sales made to clients who accessed the Company’s website via the Affiliate’s links.
A tracking system is in place for seven days to attribute sales to the Affiliate when the client accesses the site through one of their links.
Article 5: Duration and Termination
This contract is concluded for an indefinite period. Each party may terminate it at any time by notifying the other party in writing 30 days in advance. In case of violation of the contract terms, the aggrieved party may terminate it immediately and without notice.
Article 6: Conditions of End of Affiliation
At the end of the affiliation, for whatever reason, the Affiliate commits to remove all affiliate links from their promotional materials within 7 days. Commissions generated before the end of the affiliation remain due, subject to the conditions stated in this contract.
Article 7: Payment of Commissions
The payment of commissions is conditioned by the full payment of the services by the client. Commissions are credited to the Affiliate’s account within 7 days following the receipt of full payment for the services by the Company.
Commissions are paid upon presentation of an invoice from the Affiliate, via bank transfer. The Affiliate may not present more than one invoice per month. In case of a full or partial refund to the client, any commission related to that payment will be deducted from future payments to the Affiliate or, if necessary, refunded by the Affiliate to the Company.
Any client who visits the site without using the personalized affiliate links of the Affiliate cannot be attributed to them. Consequently, this will not result in the payment of commission for such visits.
Article 8: Promotion of the Company’s Site
Following acceptance of the Affiliate’s application to the Company’s affiliate program, the Affiliate commits to placing at least one hyperlink from their own website to that of the Company within 14 days. Should there be no link after this period, the Company may close the Affiliate’s account and terminate the partnership.
Article 9: Communication
The Company is authorized to use the name of the affiliated entity, as well as any associated material provided by the Affiliate, in its paper and digital communications for promotional or informational purposes. As such, the Affiliate may be presented as a partner of the Company.
This use does not confer any property rights or other exclusive rights to the Company on the trademarks, logos, or other intellectual properties belonging to the Affiliate. The Company commits to use these elements in accordance with the image and values of the Affiliate, and only in connection with the promotion of the services for which the affiliation is established.
Article 10: General Provisions
The parties commit to comply with all laws and regulations applicable to the execution of this contract. This contract constitutes the entire agreement between the parties regarding its subject matter and supersedes all prior agreements, whether written or oral.
